There are two main types of power of attorney documents that we recommend for all our clients.
The first is an enduring power of attorney which grants someone else to act on your behalf of personal and financial matters. This will enable your attorney to act on your behalf in relation to matters you have authorised them to act.
The second is an appointment of medical decision maker. This enable the medical decision maker to make medical decisions on your behalf and to speak with your treating practitioners.
For most individuals, we recommend the option of the attorney documents only coming into effect if you lose decision making capacity yourself. If an unfortunate event occurs where you lose capacity, your next of kin will need to go through various processes via VCAT to obtain an authority to act on your behalf. This can be quite a stressful process for a loved one who is also dealing with the trauma associated with such an unfortunate event.
Attorney documents are particularly helpful for elderly citizens who require assistance with the day to day administration of their affairs.
